Abstract: Abstract: The paper deals with the judicial practice under the Umayyad and early Abbasid caliphs. It adresses three questions that arise in connection with the oath and the establishment of the truth in early Muslim judicial hearings: what was the role of assertoric oaths in the actual court practice? Where can the possible roots of this procedural requirement be found? What does the adherence to the oath imply about the character of Arabic-Muslim domination under the Umayyad and Abbasid caliphs?
